Preamble
LIT AM LLC (hereinafter referred to as the Operator) operates the website (www.asomanager.io, www.app.asomanager.io), a web-based application for generating ASO text assets (Platform). These Terms of Use apply to all users of the platform (www.asomanager.io, www.app.asomanager.io) (hereinafter: the User).
Rights of use
2.1. The User may use the platform which is accessible under (www.asomanager.io, www.app.asomanager.io) for commercial and non-commercial purposes.
2.2. The Operator has the right to restrict the use of the Platform without giving reasons or to block Users.
2.3. By giving consent, the User agrees that the Operator may store the User’s IP address and other data to verify extensive use of the Platform.
Rights and obligations of the User
Warranty and liability
4.1. Your use of the Platform is at your sole risk. The site is provided on an “AS IS” and “AS AVAILABLE” basis. AI ASO Manager expressly disclaims all warranties of any kind, whether express, implied or statutory, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. AI ASO MAnager makes no warranty that (i) the Platform will meet your requirements, (ii) the Platform will be uninterrupted, timely, secure, or error-free, or (iii) the results that may be obtained from the use of the Platform will be accurate or reliable.
4.2 You understand and agree that AI ASO Manager will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or damages for loss of profits including but not limited to damages for loss of goodwill, use, data or other intangible losses (even if AI ASO Manager has been advised of the possibility of such damages), whether based on contract, tort, negligence, strict liability or otherwise, resulting from: (i) the use or the inability to use the Platform; (ii) your access, use, creation of, or interaction with any Content, Generations; (iii) your sharing with any third party of any Content, Generations; (iv) unauthorized access to or alteration of your transmissions or data; (v) statements or conduct of any third party (including users) on the Platform; or (vi) any other matter relating to the Platform. In no event will AI ASO Manager’s total liability to you for all damages, losses or causes of action exceed the greater of: (i) $100; or (ii) the amount you paid AI ASO Mnager (if any) in connection with your use of the Platform.
4.3 Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations set forth above may not apply to you. If you are dissatisfied with any portion of the site or with these terms of use, your sole and exclusive remedy is to discontinue use of the Platform.
Confidentiality and data protection
5.1 All data protection information is available to the User at www.asomanager.io/privacy.
Concluding provisions
6.1. Legal disputes arising from this Contract are governed exclusively by Armenian law.
6.2. The exclusive jurisdiction for disputes arising out of or in connection with this contract shall be the competent court in Yerevan, Armenia.
6.3. Changes and/or additions to this Contract must be made in writing to be valid; written form is also required for departure from this formal requirement.
6.4. Should individual provisions of this Contract be void, unenforceable and/or invalid, this shall not result in the invalidity, unenforceability and/or invalidity of the entire Contract. In this case, the contracting parties undertake to agree on a provision which is as close as possible economically to the purpose pursued by the void, unenforceable and/or invalid provision to replace the void, unenforceable and/or invalid provision.
